Terms of Service for Jazz Jam Studio

Introduction
These Terms of Service ("Terms") govern your use of the Jazz Jam Studio mobile application ("App") and website ("Website"), operated by Jazz Jam Studio ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Licence to Use the App
Subject to your compliance with these Terms, we grant you a personal, non-transferable, non-exclusive, revocable licence to download and use the App on devices you own or control, solely for your own personal, non-commercial use.
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer or attempt to extract the source code of the App, except where this restriction is prohibited by applicable law
- Use the App in any way that is unlawful or that infringes the rights of others
This licence does not transfer any ownership of the App to you. All intellectual property rights in the App remain with us and our licensors.
In-App Purchases
The App offers an optional one-time in-app purchase, "Pro Unlock", which permanently unlocks additional features for the account or device on which it is purchased.
- Pro Unlock is a one-time purchase, not a subscription. It does not auto-renew and you will not be charged on a recurring basis for it.
- Purchases are processed by the platform's app store (Google Play or, where available, the Apple App Store), not by us directly. Your purchase is also subject to the applicable app store's terms.
- Once unlocked, Pro features remain available on the purchasing account, subject to the app store's terms and your continued ability to access that account.
Refunds and Restoring Purchases
- Refunds for in-app purchases are handled by the app store through which you made the purchase. Google Play and Apple App Store refund policies are the governing authority for any refund request; please refer to and follow their respective processes.
- Restoring purchases: if you reinstall the App or switch to a new device using the same app store account, you can restore your Pro Unlock at no additional cost using the "Restore Purchases" option in the App.
Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that defects will be corrected.
Nothing in these Terms limits or excludes any rights you may have as a consumer under applicable mandatory law that cannot lawfully be excluded.
Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of (or inability to use) the App, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total liability for any claims arising out of or related to these Terms or the App will not exceed the amount you paid us, if any, for the App in the twelve months preceding the claim.
Governing Law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict-of-law provisions. Any disputes arising under these Terms will be subject to the competent courts of Spain, without prejudice to any mandatory consumer protection rights available to you in your country of residence.
Changes to These Terms
We may update these Terms from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date above. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
